The 8th Amendment has a prohibition against excessive bail for those accused. Except for capital cases in which it is announced that the death penalty is still a possible penalty, everyone charged with an offense has the right to a bond hearing to seek a reasonable bond. Once a bond has been set, the prosecutor can seek to revoke it/change terms and consitions and/or increase the amount. The main reason to increase it is where the court determines that the accused is a flight risk. However,beyond the possibility of absconding, the court may also revoke bond once additional affidavits have been filed that there is evidence that the accused is a substantial risk to the safety of others. In reality, this guy is not bonding out. The court will determine at a later hearing, if he has the 40K and/or can pay the bond premium, that he is a potential danger
